Unhappy some1 plz help me!!!! :'(

hi my name is joe and me and my g/f just had a beautiful baby boy...he is 4 months old and his name is adam....but heres the problem...well see i am 19 and my g/f is 15...and im not sure whos has custody of the baby me and my g/f or her mother...i live in new york, her mother is always threatening her about how she has custody of the baby and how she can take him any time she wants...well i need facts...me and my g/f love eachother very much and wish to be married but in new york u cannot get married without mothers consent if u r under age and her mother will not give that to us....i love my child and so does his mother but with her mother always threatining us we do not know what to do...some1 plz help me

Unless you guys signed over rights to her mother then you two are the legal parents. You two get to decide what is best for the baby. This site http://www.nyclu.org/rrp_rppt1a.html will give you more information on your guys rights as parents in NY.

I'm sorry you're in this situation. Hopefully the grandmother will calm down when she realizes that she can't control this situation. In the meantime you can look into establishing paternity and taking physical custody of the baby yourself but that may just make her more upset.

I don't know the laws but in md once you have a child a minor is imanciated under the law. I'm sorry for your sitution. And wish the best for youand your family.

I don't know the laws in NY, but where I live once you give birth to a child and you decide to keep it, the mother is considered an adult. Now for the mother, how dare she. She needs to do her research, because she has no legal rights to this child whatso ever. Now, unless you have given up your parental rights to the child to her, don't worry about her. I'm sorry that your in this sad situation. I hope you and your loved one have a happy life and family together!

parental rights

Every parent has custody of their children from birth, even if they are a minor (under 18). Grandparents have no legal rights unless CPS has taken the child away because of abuse or neglect and placed the child with the grandparents.

Establish paternity on your part and take responsibility for your baby. Then grandma has nothing to quack about.
