My husband and I are in the process of petitioning to have my older daughters last name changed. Her BF is in agreement and consenting to the whole thing. Man did I get lucky to have an ex like him. However, this is going to bring up issues for my youngest daughter, not having the same last name as the rest of her family. My youngest daughter turned 4 this past May. I have been married for 1 1/2 years to her step dad. Her BF(different guy) has not made any contact for over 3 years. He is not listed on her birth certificate(he was in jail) and no paternity has been established. When he was in contact for the first few months, he had stated that he would never sign over his rights, however, aside from no contact, he has an extensive criminal background, and no known residence. I know that we will need to put some sort of add in the paper but how long do we have to run it. My husband has wanted to adopt her since we met but we just cannot afford a lawyer. We live in Montgomery County TX. Any help is greatly appreciated.
