Anyone know this info????
In the state of Texas, Can you terminate a bio parents rights without an adoption taking over?? And if so, will this stop the child support. My ex wants me to hurry up and get it done and its taking forever and he has threatened to change his mind. I will carry out the adoption once I get the money for the home study.
So can we terminate his rights without my husband adopting my kids right now?? and if so willl the child support end?? PLEASE I NEED SOME ADVICE |

I'm thinking that a judge will not terminate a parent's rights without good cause (such as step-parent adoption) because who would be responsible for the child if something were to happen to you? Just a thought, and from what I've read in researching the same thing. I believe a lawyer advised me of this... I've read and spoke to so many people I can't remember where I heard this! When he terminates his rights, he is no longer financially responsible for the children, so yes, all child support ends. I have friends in Texas who did this. The Bio D signed his rights away and later the stepdad adopted the 3 kids. If you don't have one, get a lawyer to do this.
If the bio is even thinking about terminating, it's unlikely he would just change his mind because it's taking longer than he thinks it should. He wants you to get it done so he doesn't have to pay any more $$. I think that is were the threat to change his mind is coming from. Last edited by CaddoRose : 02-26-2008 at 06:02 PM. |

That is not true. In the state of texas child support is still required untill someone else adopts the child. Just because he signs his rights over doesnt mean he doesnt have a finacial responcibility to the child. Even after the adoption goes through you can still make him pay. He just has to have visitation rights.
