Parental rights terminated in June 2006
Ok here's my situation.
My husband has been attempting to adopt my daughter since June 2005 when the original petition was filed. The ex signed that he agreed to terminate parental rights in October 2005 but our attorney did not file this until June 2006. We have relocated to Texas from California and made it clear all along that we would be moving to Texas and how this would impact the adoption. Told no problem...well here we are. I finally got a call from probate in Cali and was told the judge may dismiss because of the amount of time that has passed, and that a home study is needed. We had one when we filed to terminate rights. They need to see how our daughter lives. She mentioned that we may be able to get the DSS in the county we live in Texas to perform this but her office usually won't grant the adoption without meeting the family. She stated the judge may suggest we transfer or just refile. Thousands later here is where we are. Anyone ever had anything like this. Will Texas frown on this. Even probate said our attorney let the ball slip seriously on this. Please advise. |

I'm in TX.... I know when my x signed relinquishment papers, the papers were good for 60 days. After that, they were considered null and he could protest the adoption. I am wondering if that is what they are referring to? Good grief, the attorney waited that long to file? I would be a little upset with that. I know in our county, we did have to have a home study and our state home study would not suffice. We are trying to adopt through the state and had already completed that home study. So we had to pay to have another home study done. Redundant and costly! I think I would contact an attorney here in TX (free consultation) and ask them, just to see what your options are. Good luck!
