My husband and I have been married for 2 1/2 years. I have a 12 year old son who has never seen his father and I have never asked for or received child support. My husband wants to adopt my son and my son wants to be adopted by my husband. This is the only father he has ever known. Can someone give me advice on what we need to do. We are in Texas.

First, do you know where the bf is and if he's willing to relinquish his rights? If so, it's a pretty easy job. I have the forms and info on doing a step-parent adoption.

Thanks for the reply. I do not know where he is although I might be able to locate him. He has never seen my son and I have not seen him since I was pregnant. Do I need to try and contact him even though he has never been a part of our lives? He did know I was pregnant by the way. Thank you, Tami (-;

I'm in Collin County. The Judges here will not proceed unless the bfather can be tracked down. If you have been set up through the AG's office and they have been trying to track him down then that should help you prove he has no interest. Also, if there has been no CS payment or attempt at contact for at six months then you should be good to go!!

My ex is fighting the relinquishment, so if you end up with a fight on your hands I may be able to provide some info.
