BF pays support, s/d wants my name
My 12 y/o step daughter wants my name. Her bf pays support but has no contact with her unless her half sister picks her up and takes her there. I would like to adopt her. Do I need his consent?

I have a friend that is going thru this and ex pays child
support but has never spend time with her, she does not even know where he lives. Her soon to be step dad the only dad she has know wants to adopt her. They have had to hire an attorney and try to locate the bf to sign his rights away. I do not know all the legal part of it. I hope everything thing goes good for all of you. I do know since he does pay child support he will have to sign his rights away in order for sd to adopt her. sarah |

Info
mcowan7,
Your step daughter has to be age 10 or older in order for you to go to court with her approval. Yes, the BF has to be notified in regards to the name change. He may or may not show up. I have the form for name change of a minor if you would like it. My son is 13 and we are headed to court for the second time on the 18th of this month. If you need any help just let me know.

what if the child is younger then 10? Do we still have to have someone talk to her about the adoption? or can we just make the choice and do it for her? My ex just signed the voluntary reliquishment today....

Tx taylor was commenting on a name change only. To actually adopt, the father's rights would have to be terminated. He would have to be notified and would have termination papers to sign.
