what is with the court system???

cousin had court today and got her baby back. even though they had tpr'd 3 other kids less than 2 years ago!!!!!!!!!!!! what in the world? the atty argued that past cases can't be brought up? i thought that held water in texas, according to what i've read, it's cause for another tpr. the judge said 'i remember you, i remember your ot her kids, and i can't believe that the state didn't p rove their case and i have to give your child back!' ugh. the caseworker sat on the stand and answered everything with 'i don't know. i'm not sure'. she didn't feel there was a problem and her higher ups made her take the child, so her way of getting the child back to mom was to not answer anything.

I don't know if it is cause for TPR with a new baby or child that wasn't involved in the last investigation. I think (not sure) that it can be brought up when there is a new investigation with a different child.

I'm on the sidelines of a similar case in Tx. This is what I've been told.

it was my understanding also. but the lawyer said it couldn't be brought up and the judge went along with it. then the lawyer said 'mom is moving from home to home beccause of the economy, you can't blame her for that'. and yet.....she's lived that way always, moved from home to home and not held a job. it has nothing to do with the economy, it's her lifestyle choice. i'm just ad for the baby.

Same here. I would have rejoiced if the bmom in my case had changed and been able to parent. Sadly, she is still living in homes where drugs are being used and sold.

My AD had tpr march 2007 another baby born sept 2007 cps was waiting at hospital for removal. birthmom KNEW it was going to happen so she already had friend there to take custody of child so it wouldnt go into foster care. CW already told her that if she is pregnant again AD's case WILL play a factor in rather or not she keeps any future children. She will technically only have one removal since she voluntarily signed rights to second baby, but cps still shows an involvment. Id be upset if I was you, if birthmom really has not changed.
