that is a tough one.....
It happens sometimes....depends....does your social worker love and adore you? How about the child's worker? If the child's parental rights are going to be terminated and when? All of this will matter. Most likely if you have only had this child 3 weeks they will not let you take him. The best thing to do is get on the good side of his worker. good luck and God bless!

It would be very rare for a child in Foster Care to be allowed to move out of state. The issues are extensive. First of all does his biological family have any right to visistations? Until the TPR is completed in most cases the bio family is given the right to visits and can exercise those rights even if they have failed to do so until right before the TPR....
It is possible to have a child who is placed in a pre-adoptive home be placed in another state. There is paperwork that the Federal Governemtn requires when a child will be adopted by a family in another state the short hand for it is: ICPC this is an interstate compact agreement and basically sets up the supervision prior to an adoption being final with the state the child is being placed into. Again this is done for pre-adoption placements. Children in Foster care who do not have a TPR have caseworkers, judges and often special advocates assignned to oversee the childs life while it Foster Care--it is not likely that one state will be able to convience another to take a new case with so many issues. And the state the child is in now will be responsible to re-pay the other state. Some of this would also be political as numbers of children in Foster Care and what happens to their case is important info for each state Social Services departments. I know that most children waiting for adoption have to be comepletely legally free before a family from another state is able to ask to adopt them. I can also tell you that in my state our children were placed into a pre-adoptive home, and even after the TPR we were required to complete a massive amount of paperwork just to take them on a trip to another state---my husband works in another state and last year he could NOT take our daughter across state lines for take your kid to work day! We also had to sign a release for our vacation that in the event of a medical emergency we might have to assume the full responsibility of the bills if the other state did not honor the medical coverage our state offered. It would be very rare for me to hear that a Foster Child was permitted to move to a different state with a Foster Family. Please keep us posted if you find out anything different as this is an interesting situation and one I think comes up more often then we even know.
