Exclamation Marriage Before Adoption??

My husband is trying to surrender his parental rights to his son that the man that he's known as 'daddy' can adopt him. The mother and this man are not married and I was wondering if anyone knew if they had to be married for him to adopt the child. We live in Texas and the mother and child live in New Hampshire so I'm not sure about the law differences between the states. The mother says that the paperwork is ready to be filed and she waiting for a surrender of parental rights form from my husband. We're going to send the paper but I just wanted to know if adoption is actually possible if they're not married. New Hampshire won't let him surrender his rights unless an adoption is taking place.

I believe the couple usually has to be married...for atleast a year...to begin step parent adoptions. I could be wrong but I think that is still the requirement.

Not sure about New Hampshire or Texas, but in CA the couple has to be married for at least a year before they can file for the adoption.
