Need Prayers...possibly lots of them
We had a Hearing this morning on the TPR my ex received in March.
He was served in front of his attorney but he did nothing to ty to stop the termination!! He Ignored it (typical behavior for him). At the time he retained 2 attorneys. Neither attorney filed anything contesting the TPR. 20 days passed. April 26th we went before the Judge, the Judge signed the TPR and he waived the ad litum, told DH to get his background check done and appointed an investigator for the Home Study. We had everything done in a week!! In the beginning of May the ex's attorney started claiming they knew nothing of the termination. So we weren't able to prove up. Today was a hearing. He was on the stand contridicting himself. He would give a different story about when he quit using drugs, about paying child support, about not seeing DD. It was insane!! My attorney was calling him on every little lie and provided court documented proof that what he was saying was not true. He made it clear on the stand that he knew what the TPR was about and he admitted to doing nothing to stop it. My attorney also pointed out that so much time was wasted he lost the opportunity to appeal to the Texas Supreme Court...his appeal can go no higher than this Judge's court room. My Attorney submitted tons of documentation and case logs to back up her fight. She wasn't letting it go!! The Judge told us he will make his decision as to whether or not this will go to trial later this afternoon. My Attorney couldn't figure out what the Judge's feelings are on this. It could go either way. I am hoping the Judge will stand by the TPR he signed and deny the Trial. I am alo hoping the Judge will see that my ex is manipulating the Court System, like he did in the past. The proof of this pattern is now with the Judge. Please, please, please let the Judge stand by the signed TPR!! Please let the Judge deny a trial!! DD is happy, healthy and she loves DH.

Still no word!!!
I just called my Attorney's office and the Judge STILL has not made his decision!!! Why would this take so long??? We have done everything!! I have all of the court documents showing it is best that DH adopts DD!! Even a Social Study from 2003 recommends visits should be limited and supervised because something isn't right. My Home Study done last month recommends the adoption takes place ASAP. Why is it taking so long for the Judge to decide????  Please Judge, stand by your signature from 4/26 and say no to a trial!!! Please, please, please!!!!! This is going to be a long day isn't it????

We have to go to trial.
I feel better now that I know. So it will be a mad dash to get ready for trial that is set in about 2 weeks (we had this date on the docket already...just in case)

We are still on for trial this Monday.
I'm still rather curious. Why would the Opposing Attorney ask to change our trial from Termination to Termination AND Adoption. This has been driving me batty!!!! Why is the Opposing Attorney concerned about the Adoption piece??? Hoping and praying this will be it. I have tried so hard to have faith that the courts will do the right thing...please don't fail us now!!!

Trial starts today. We have CPS testifying on our behave (they were the ones who had the drug testing done). Hopefully the Judge will listen to CPS, stand by his original decision to terminate and everything will be done this morning. DD desreves to stay happy and healthy and DH derserves to be her legal Daddy. She loves him so much and he loves her too.
I hope this doesn't get pushed off any longer.
