Heart Native Indian? Or NOT Native Indian?

HELP!!! I am adopting my husbands children and we were just told that the Mother, who is not in the picture, nor is she allowed to visit with the childre, for abuse reasons, may be of Native American descent. Does this affect our adoption in any way?

Someone correct me if I'm wrong, but I don't believe that ICWA applies to step-parent adoption. Since the child is obviously with the custodial parent, you should be able to adopt as a regular step parent adoption without even having to notify the Nation that the mother belongs to.
