My ex-husband passed away in March. I have a 12 yr old daughter from him. He was never in her life and never worked a REAL job. Which means she was not able to get death benifits from social security. I remarried when she was 2 1/2. My present husband is the only father she has really known. We would love to have him adopt her. She wants this very much also. Her biological father would never give up rights, just to spite me. This adoption has never been possible until now. I need to know where to start. Please, if you have any info let me know. Thank you!

Since the biological father is deceased you won't have any obstacles to get around. I'm not sure what state you are in, but I have information in regards to a step parent adoption. The only thing you will need to do is get a copy of the biological father's death certificate to prove why the BF isn't in the child's life and why the adoption is in the "best interest of the child".
