What about a name change?
I asked my ex if he would consent to a step parent adoption and I was telling him all the reasons I felt it was in my daughters benefit and one of them was having the same last name as the rest of the family and he said "so change it then." yet, he won't, as of yet, consent to the adoption. Typical of him. Has anyone here gone that route and already done a name change before the adoption? I was wondering what was involved. I know it is not near the same as an adoption but it does get confusing at times for people that my daughter and I have different last names.

As an adult, your daughter can change her name, legally, to just about anything! But as a child, it's a bit more complicated.
My ex agreed to the step parent adoption because our son, specifically, requested it. If your daughter is old enough, see how she feels about writing a letter to bio dad. It worked for us! Summer |

It is probably possible to get a child's name changed to your own in your divorce action. That's what my wife did - just filed a pleading in her divorce saying "my name is now xxx and I'd like to change the child's to that too." Ex didn't respond (he was in jail), so it was ordered.
