birth mom revoking consent
A friend would like his current wife to adopt his two children. He has had sole custody since the children's mother left and they divorced 7 years ago. The mother has signed the consent form and agreed to the adoption and it has been filed at the court. Now her mother (maternal grandmother) wants her to stop the process. Please reply if you have any insight on how to get this adoption to go through. Both children understand and approve of the adoption. Can the mother revoke her consent or stop the adoption?

On every consent form I have ever seen where revocation of consent is possible, the revocation needs to be done with the approval of the court. She may ( depending on what state you are in) be able to revoke her consent.
That does not necessarily mean that a stepparent adoption will not occur. It may happen without her consent if there are other statutorial grounds. If she does have her consent revoked they may have to proceed with the adoption as a contested one. She may not follow through with the revocation if it requires court hearings and then there is the possibility the court may not grant it. I hope this helps. |
