Hi, again. I started posting on this site a while ago about my dh adopting my dd. We went to court, and the bio dad's rights were terminated, and the adoption was granted. This was more than two mo. ago. Now, I am getting phone calls from bio dad's family, saying that he had no idea he had to be at court. I'm confused and was wondering if he can have things changed? We went through a very good and well respected attorney and the bailiff stated in the court room that bio dad had been served and notified to be in court. We've already gotten the new birth certificate and I am afraid he can drag this back to court and turn her life upside down again. Thanks for listening! |

If the service papers were filed in court....he cant do anything-it is your responsibility to serve him...his responsibility to read them. Congrats on completing your family!

Thank you so much! I tried to contact our attorney that handled this for us, but he was in court today. You have kidted a huge weight off my shoulders, our dd is so happy now and has already been through more than anyone should have to. Thanks again, and God Bless you!

I agree - if he was served with the papers, but still didn't show up for court, that is his problem. My guess would be that is just the excuse he is using to explain to his family why he didn't show up. Good luck, I hope they don't cause you too much stress!

If you have the new birth certificate already its a done deal. He has 60 days after the original hearing that the termination was done to file an appeal. If the court allowed you to proceed with the finalization process and you even had enough time in there to recieve a new birth certificate its a done deal. Take deep breaths your in the clear.

I was able to speak with our attorney about this late the other day, finally. He said that Bio dad is a bold faced liar and that he has the papers showing that he was served with the papers on when to appear in court, that he is just trying to save face to his family now. I'm so glad that we don't have to go through any of this anymore. Our dd is a wonderful child and it's a shame that he didn't want to be a part of her life, nor his family until now. She is much happier and already seems more positive about things.
