Question address change

Hi Everyone, I am moving in a few weeks. Same town. Our court order says that we have to notify each other within 24 hours of new address and phone numbers. I have no idea where he is. I haven't spoke to him in about 8 months. He doesn't pay child support and has lost all visitation due to drugs. All the phone numbers I have for him are disconnected and he has moved away from all the addresses I have had. Here is the deal, my husband and I want him to adopt my daughter. In 4 months I can file for abandonment and have that happen. I don't want my moving to mess that up because he doesn't know the new address since I can't find him. Do you think I should do a publication in the newspaper or something saying to contact me at my work for the new info? I have worked at the same place for 6 years and he does know the number here. What do you think?

See a lawyer to be sure of what you must do in this case. I think you are probably right about the newpaper announcement though because what else can you do? Don't risk messing it up though over spending a few bucks on a lawyer. For the amount of his time he will have to spend with you it may even be free advice. Good luck.

We had the same problem. We had to have the courts send the information to her last known address with the information. They thhen kept it in the case file along with all the other court orders and non-compliance issues. You are lucky to have to only wait a year. We had to wait two years before I could adopt my daughter. Good Luck!

Thanks, I will contact the court here and see what they say to do. I just want to cover my behind from every angle if you know what I mean. I would hate to wait this long for them to throw it out because he didn't know where I lived! Could you imagine. Well, Thanks for the responces. I'll keep you posted

I agree with the other 2 replies-

You should probably contact an attorney. My state law read's that you must send notification to the last know address of the defendant. It must be sent by certified mail & if he doesn't get received it it will be marked as un-deliverable or not at this address.

OPutting an add in the local paper of the last known town he lived in for 6 week's would also be a good idea.

I would still contact an attorney to consult the situation with. If you don't have an attorney, you may be able to call one up for a free phone or in office consult.
