Exclamation BF in Prison, Husband wants to adopt son,,,

My son's BF is in prison until the year 2009. My son will be 2 yrs old on July 4th. I recently became married and my husband wants very much to adopt my son as his own. Does anyone have any information on how hard or easy (i hope) this will be. Where do we start, what do we do, who do we contact. We are located in NY, my husband is in the Army. The BF is in prison in Michigan, and I have a good feeling, he would not give up his rights willingly ,,,, would a court/judge terminate them based on his criminal record and because of him being in prison? He has a record for csc 2 degree (criminal sexual conduct with a child under the age of 13) So it's not like I want him near my son anyway!,,,,,,,,,,,,,,,
Any suggestions ?

In some states a felony conviction is enough to get rights terminated. The length of his sentence and what he is incarcerated for are grounds for termination, you may have to wait a certain amount of time for your husband to adopt, it depends on what state you live in. Some states require a minimum amount of time of being married before you can adopt(i.e. 1 year).

I would think the criminal sexual conduct would be enough to get his rights terminated. At least, from what I've read about the laws in my state, it is.
