Trying to get OBC from MA courts...for Irish citizenship

Hello everyone!

I am posting to see if anyone here has had success in getting their original birth certificate from Massachusetts for reasons other than identifying birth parents' names.

I already have identifying information about my birth parents and I am currently in reunion with my birth mother. The reason I'm trying to get my OBC is to get Irish citizenship! My bmom is an Irish citizen, and due to the citizen by descent method I can become a citizen of Ireland/the EU. The Irish Embassy has told me that if I can provide information stating that I was, indeed, born to an Irish mother I qualify - even if I was adopted to non-Irish aparents! This will make international travel a whole lot easier for me when I go to Europe.

Has anyone else done this before?

I'm getting the motion/affidavit to open my records in the mail, and I'm looking for any advice on what to state in it to make it a "good enough" reason for the courts to open it. Any ideas?

Kelly, what year were you born? I thought all pre-1974 OBCs were able to be accessed by the adopted person? (DH just got his recently). GOOD LUCK!!!

Kelly,

Can't your bmom request the original birth certificate? I mean there is no confidentiality for her -- she would be the one person who already has all the information -- or so everyone would assume.

Kelly, if that doesn't work, I think maybe filing the form and an affidavit from your birth mom that you are in contact, and the whole purpose...hopefully, no judge would deny that (I hate that they cut off the records after '74...ridiculous!). good luck!

Yeah...I can't see any logical reason that they wouldn't want to release it to me, but stranger things have happened. My bmother is a being a huge help in it...she was the one that told me about getting the citizenship.

Exclamation Update...

So I called back the court and asked them if it was easier for my bmother to request my OBC. They said no, that she would have to go through the same process (the affidavit and all) that I am. Weird.

However, the person I spoke to told me that really there's no reason that the judge should deny my request considering the fact that I know EVERY DETAIL on the OBC and that I should get my bmother's signature on my motion as well, if possible. So that's what I will do.
