question about 10 day waiting periods

From a previous thread, it was made clear to me that during my upcoming second trip this fall, the 10 day waiting period in all liklihood will not get waived.
My employer has offered to fly my wife and I back and forth to the US and Russia during this period. As much as we would like to spend this period with the kids in Russia, as we have 4 kids currently at home, returning at my employers expense would benefit us financially. Upon excersizing the 10 day waiting period, do the courts generally expect adoptive parents to stay in Russia with the adopted kids? Will returning to the US hurt the adoption process or is it not relevant to the courts how we spend those 10 days.

It didn't seem to bother the judge one way or another. We explained that we had a child at home too and that seemed to be all that needed to be said. This was the Moscow region.

We stayed during the 10 days but another couple who had court the same day as we did left the next morning and returned after the waiting period was up. It was never even brought up in court if we were staying or leaving. The judge didnt care either way. We were in the Krasnoyarsk region. I never heard of a region where you were "required" to stay with the child. I am sure your agency will know for sure.

It is still region/judge specific whether the 10 days are waived...with 4 kids at home, it is possible that the judge will accept that as a "good" excuse to waive it.

In our region, we had ours waived, the family before us did not....

Also, I have heard in some regions, they do not allow you to see the kids...(who knows why), so in that case, it would only make sense to come home.

I have also been told in some regions they want 1 parent to stay in country.

So there are a lot of possibiliites..I would ask your agency.

Adopting kidsa after having 4? That is great...and BRAVE! I can't keep up with one!! haha

We adopted our 6th child this spring. Our 10 days was waived in a region that historically does waive it. The people a few days before us however did not get it waive. We came armed with a letter from a relevant medical specialist stating that our appointment was within the next week and that we would be unable to get in again until late summer if we did not make that one. We also stated that we needed to get home to our work and our other 5 children.Good luck!

Fortunately, our 10 days in St. Pete was waived in May, however, the judge never asked if we were staying or returning home. We met couples that were staying; others were returning. Didn't seem to matter.

Our ten-day wait was not waived. Then again, it is typically never waived under any circumstances in the region from which we adopted our boys. As for leaving and returning home during the 10-day wait, I really don't think it will matter to the judge/court.

We came home to save the time at work. If your employer is paying, I say take them up on it. We missed out little one but it gave us time to prepare more things for her before she got home.

Hi "NJClan9"... talk to your AGENCY!!! They will know what is CURRENTLY happening in your region and possibly how the judge views/requires things. I have also heard, that in the "future" one of the changes they want to make, is that Parents will NEED to stay in country for the 10days! When and IF this ever happens, your agency will know and prepare you for it.

I adopted in Dec. 2004, and even though I was a single parent (sole working provider), and DD that I was adopting was severely malnourished, (8.5 months old, weighing only 34 lbs!!!) and in Russia's eyes, considered "Special Needs"... the JUDGE in the Moscow region REFUSED to waive the 10 days, though he did ALLOW the weekends to count (Which they usually do not count in the 10 days). Not that this helped me any.... Court was 12/23/04.... 10 days ended when their 10+ days of HOLIDAYS started... I COULD NOT afford (on many fronts) to stay in country, and had to ASK THE JUDGE to travel home and come back... He did grant that one.

When I went back to the orphanage to see DD the next day, (which was a Friday), they told me that I would NOT be able to see her or take her for the weekend back to Moscow, as it did NOT matter them that the Judge granted the adoption... So I had to change my plane ticket to depart on Sunday (whereas Saturday was CHRISTMAS)!!! I was depressed that I couldn't spend the time with her, but I did actually leave my Hotel room on Christmas day, and went to RED SQUARE by myself.... Even had a picture taken standing in RS infront of a Christmas tree so that Family and Friends know that I DID leave my room!!!

Anyway.... Talk to your Agency and get the latest for YOUR REGION, as sooooo much IS Region Specific, and how the Judge views the individual Child/ren (special or medical needs, etc.).

Further, in some regions, you get custody of the child(ren) during the 10 day APPEAL period. (It's not a "wait"...it's a legal rule for all court decisions rendered by a judge, not just for adoption, that provides both parties an opportunity to appeal the decision before it is officially recorded)

As A posted in the previous reply...talk to your agency about the specific nature of your region and orphanage/Internat.
