Green Cards???
Hello all!
I was able to have my INS ? answered by my agency. Apparently, since you have a POA for your spouse, it doesn't matter who stays in country. Now...here's the question. My agency tells me that if only one parent returns with the child, they will only receive a green card upon arrival in the US and not an automatic certificate of citizenship. Has anyone had trouble with applying for citizenship for their child upon return to the US? Was it an expensive or difficult process? Thanks in advance for the information. ![]() |

I don't think this is true as long as you have the Power of Attorney and can prove to the embassy that both parents met the child prior to the adoption (like photos from trip 1). When we adopted DD in September 2005, my DH came home immediately after court. (I stayed to wait the 10 days for the passport). When we got home my daughter was processed through just like the family where both parents stayed...and we received her CoC automatically.
There are some extra paperwork steps you have to take for the embassy, but as long as you've both met the child and both appeared in court, then I don't think one parent leaving early changes his immigration status. He should still get the CoC.

Same experience as Kim. I sent you a PM. You don't have to readopt, you will get the CofC automatically.

We are making 3 trips since the 10 days won't be waived. I will be returning the Moscow on the 3rd trip without my husband. I am going to have a POA and pictures showing he has spent time with the child.
We just let our agency know this beforehand so they are aware of this. |
