We have a strange situation, my ex-husband has had very little contact with our children since they were 10 months old. They are 3.5 now, and my husband (who has been with us since they were 18 months old) wants to adopt them. Tonight I discussed the possibility with my ex that he relinquish his parental rights. He says he thinks my husband is great for our children, and can understand the desire to adopt, but he is afraid to relinquish his rights because he doesn't want to lose contact with the kids. I've made him an offer of a legal contract, much like the custody agreement we have now, but with more restrictions. Is this possible? It would make my husband and I feel much better about the welfare of the children (rather than the court allowing him to take them, regardless of the best interests of the children) and I think it would open up a lot of communication and trust between the three of us. I'd like to make this work to everyone's satisfaction, and in the best interest of my children, without crossing the courts. Thanks in advance for your input!!
