We're adopting but have questions!

Hi Everyone,

My sister n' law and brother have conceived a child. Although the child is biologically theirs, my wife and I are to be the child's adoptive parents. Everything has been agreed upon by all parties. We are treating the situation like a surrogacy with donor egg and sperm, as neither my wife or I are able to conceive or utilize the in vitro process.

Our questions are, what is the process we must go through to complete the adoption once the baby is born? Additionally, will we need a lawyer or just an adoption kit? To complicate things a little, the baby will be born in a different state than we live in.

So, we're really just looking for advice on how to complete the adoption when both parties are 100% willing. We're looking into lawyers but one of them already estimated around $10k! I think he's a crook! We're also looking at Idaho adoption laws (where our bro and sis live) and can't find anything about relative adoption. We'd just like to have a better idea so we can speak intelligently with a lawyer.

You can't do this as a surrogate if neither your egg or your husbands sperm were used. It will have to be an adoption. You will need an agency or lawyer depending on the state the child will be born in and you also MUST have a completed homestudy. Check your state laws and your brothers states laws on adoption. Also there will be interstate compact that will have to be completed.
