Just an update on my situation. My nephew and his wife still say they want us to adopt thier little girl. They are not in a position to take care of her and now that she will be well taken care of. Social Services is fighting this. They want the foster parents to adopt her and will do anything they can to make that happen. The Bio mom and dad know that if that happens they will never be able to see her. They just want what is best for their little girl and by having us adopt her they know that they can still have contact and that they wont completely lose her in the system. They are currently talking to their lawyer and having the county attorney draw up papers to voluntarily termintate their parental rights. The mother has also spoken to ICWA and eplained what she would like. They would like her to try to get the child back but the mother feels that she is not in a position to do that and I honestly think she just wants to go on with her life. I am going to try to talk to a lawyer due to the fact that this is what the parents want and since they still have their parental rights why cant they decide whats best for their daughter. Social Services told me that they would fight this and take it to trial if they had to. But I don't know how much they will have to say since ICWA is involved.
