my husband and i are trying to adopt his nephew. we have gone to all of the classes and done a homestudy and even gone committee. he has been with his foster family since he was 3weeks old and he is 18months now. we are 20 and 22 and have ran into a lot of discrimination because of our age. the foster family is trying to adopt him also and want a closed adoption. we were recently turned down at our committe trial because they said he would be better off with the foster family, but we requested a retrial and got that approved. we have done everything that we can to prove that we are sutible to raise him, but they are giving us grief. we have been trying to get custody since he was taken at 3weeks old, but turned away immediatly because of our age. they only allow us once a month visits for one hour and no more. all parental rights have been terminiated and upon termination the mother made the request that he was to be adopted by us to stay in his family. i have been trying to find something on family rights or laws that will show that we are being treated unfairly. i have been looking at filing a motion to intervene, but i cannot find how to do it and if it is even too late. we are looking for help or suggestions so if anyone has any please feel free.

Contact an atty. A motion to intervene is very important. My attorney filed our motion to intervene and eventually it was granted. Are you going through the classes for your own interest or did someone tell you to go to them?

we had been assigned a caseworker thru DHS and he required us to take the classes as part of our homestudy process. he also required us to do some extra projects that were not part of normal procedure for homestudy. this is why when we filed for a retrial we requested that he not represent us as a case worker any longer due do his actions and comments to us. we are now being assigned a new case worker to represent us. do you think that it is too late to file a motion to intervene since we have already gone to committee once already? does a motion to intervene give us only temporary custody until a decision is made? what is it?

Let me first explain our case. My great nephew was taken away from my neice in Jan. they placed him with his legal grandmother who we knew wasn't his grandmother at all. We filed our motion to intervene in late Feb. a guardian ad litem came to our house a week later and chose my husband and I to have temp custody while in court but this was pending paternity tests. Well the tests came back and the man who claimed my G-nephew as his son was ruled out. We took physical custody of him in May and then full legal custody in July.
It is never too late to file because in this process you need an attorney. In our experience the court system never would have bat an eye with out one. Anymore questions you can privately email me. |
