My husband and I have been married now almost 4yrs. He has a 5yr old son, in which my husband has had custody of almost a year now. Before he got custody that child was still very much part of your life. His son and I are very close and recently my husbands ex told me that I can adopt him. I have talking to a few people because this is something that I would love to do but they told me that adopting your step-child is the same as adopting any child, the birth mother has 3yrs to change her mind. I am from Pa and I am wondering if this is true? With my husband already having custody does this change how the laws were work? I am stuck here and open to any info that you can help me with. Thank you.

I have never heard of such a thing - but surprises always come up. There are SO many urban legends and myths out there about adoption that very few people actually know the truth.
The future of your family depends on accurate advice. I suggest you contact an adoption attorney in your area and take care of this the fastest, "bestest" route (especially since she seems willing right now).
