Can stepfather adopt with parent in jail?
I would like to adopt my stepdaughter who is now 7. Her real father is currently in prison. He has had no contact with her. He is going to fight the adoption (long story) so what I wanted to know is if I can try to adopt with his being in jail. They were never married but his name is on the birth certificate. He is doing time in Tx and we live in Fl. We have heard that since he is in prison that he is protected from our taking him to court. Is this true? If so it makes no sense to me that we would have to wait 40 years to adopt our daughter.
