Appeal

Anyone ever had an adoption decision appealed? My Karaganda adoption was granted by the judge by the prosecuter filed an appeal today on day 14 of the appeal period. Has anyone gone through this and know what to expect?

I'm so incredibly sorry to hear this.

A reason should be given as to why the prosecuter filed an appeal.

Are you in the states or in Karaganda? If in the states your agency should be able to tell you why. If in country your facilitator should.

My thoughts are with you and hope it will be something that can be worked out. Please update when you can!!

Thank you for your support. I am in the states. The only reason I have been given for the the appeal is that there is something in my homestudy about my being unemployed for a while. There is no such thing in my homestudy. I have been employed with the same company consistently for 10 years. I mean come on, the employment verification letter in the dossier has my start date with the company on it. Either this is not the real reason for the appeal or there is a mistake in the homestudy translation.
My agency has been great but my facilitator is questionable. The agency does not use this facilitator anymore, but I am adopting a specific child and this facilitator was the one with access to the child and a relationship with the orphanage director. My agency can only pass on to me what the facilitator tells them. All I can do is sit and wait.

There was a couple who traveled with us for whom the district attorney in the area filed an appeal on day 15 (actually the jerk put it in the mail so the judge would receive it at 5pm on day 15). They were still in the country and our agency worked very hard for them and they talked with an in country lawyer, etc.

I would really press your agency to find out exactly what is going on. Is there a specific issue or is this person like the district attorney above who was very opposed to international adoption. The adoptions in our region (kostanai and rudney) are currently being very scrutinized and maybe it's spreading. In fact, we received a letter asking us to come back (after we've been home for 3 months) to go to court for reasons I won't go into. Bottom line is we aren't going back as our kids are U.S. citizens and they are ours now, but my point is that every case is being closely evaluated. ASK ASK ASK questions to your agency. I will be thinking of you as I know this has to be so hard.

I just found out that the appeal will be heard on Feb 27th. I am just waiting and trying not to get upset about the whole mess.

Thinking good thoughts...bad vibes don't help anyone...think good thoughts...

Well, it worked for a few seconds anyway.

I just heard from my agency that court did not take place on the 27th. It was postponed until March 5th.
