The first question is about India's requirements for adoption. I'm afraid that I don't have the answer to that, but if you go to the website of CARA, the Central Adoption Resource Agency, which is the Indian government bureau that oversees adoptions, you can probably find it.

The second question is about the INS requirements for admitting an adopted child to the U.S. on an orphan visa. The child must be under age 16 in most cases. He/she may be under age 18 if the same family has already adopted his/her sibling and brought that child to the U.S. If you cannot get an orphan visa for the child because of the child's age or failure to qualify as an eligible orphan under any other section of the INS definition, you will probably have to go through the regular immigration process which can take two years.
