Just got back from Orange County Clerk/Recorders office. California requires the County to authenticate notarized forms before sending them to the Secretary of State. We are using an agency out of state. We just assumed the language they gave us on the examples and physical exam forms was okay. And it was okay prior to 01/01/05. Turns out a new law regarding the jurat form of a notary signature went into effect 01/01/2005.
Unfortunately for us, all of our forms were done wrong and were rejected, so now we have to go back and correct them before they can be authenticated. To correct them we can do an California All Purpose Acknowledgement form. This impacts all California counties. As passed by Assembly Bill 2062, Chapter 539, Statues of 2004, adds Section 8202 to the Government Code concerning jurats. A jurat form is now prescribed by law. The new jurat form that will be required is shown below. State of California County of __________ Subscribed and sworn to (or affirmed) before me on this__________day of ______________, 20___, by______________________, personally known to me or proved to me on the basis of satisfactory evidence to be the person(s) who appeared before me. Signature_______________________________ So please make sure that anything that is notarized in California after 01/01/2005 has the above text, otherwise it will have to be redone. Other folks in other states may want to verify their own county/state rules. |
