Adoption Age Limit?
I would like to know if there is an age limit on adopting someone from over seas (Taiwan). I live in California and am not sure if I can adopt another adult (33 years old).

Here's a clip from one of the adoption statues. I hope that is what you are seeking.
Jennifer -------------------------------------------------- All States, the District of Columbia, and the U.S. territories permit the adoption of a child. Three States, American Samoa, and the Northern Mariana Islands specify that the child must be under age 18. Five States and Guam specify in statute that the child must be legally free for adoption. Four States and the Virgin Islands require that the child to be adopted must be present in the State at the time the petition is filed. In addition, some States require that the child have resided for a minimum period of time in the home of the prospective adoptive parents. Approximately 23 States allow the adoption of any person, regardless of age. A few other States allow parties to petition the court for the adoption of persons over age 18 but under age 21. Alabama restricts adoption of adults to persons who are permanently and totally disabled or mentally retarded. Ohio only allows adoption of an adult when the person is disabled or a stepchild or foster child. Nebraska allows the adoption of an adult stepchild; Idaho and Illinois require that the adopting parent be in a sustained parental relationship for a specified period of time with the adult to be adopted. |

Thank you
Thank you for the quick reply post. This is helpful in that it tells me I need to look for information for my specific State (California). I'm not sure where to start exactly, but I will try some keyword searches on the Internet using California as one of the key words.
Thanks again. (If anyone reading this has specific info. for the State of California, I would really appreciate hearing from them as well.) |

You cannot adopt another adult for the purposes of immigration, which, if I'm reading your post correctly is what you would like to do.

You need to understand USCIS requirements. The state requirements are irrelevant to this situation. The upper age limit to obtain an IR3 or IR4 immigration visa is 16 years old. This person would have to go another route in order to get a visa.

Adoption for Immigration Purposes
O.k. Thank you. I had no idea one way or the other. That's too bad, really. Thank you for the information.
