Wanting a child

My husband and I are wondering about adopting a foster child. We want a girl under the age of 5 and no special handicaps. I know that most of the children in the system that are legally free and ready to adopt are older. How long should we expect before a child becomes available to us? Also, do we have to become foster parents or just go straight into adoption. I know that we need a home study done for either. My husband has a past arrest and I am not sure whether this will be an issue or not - no child abuse or anything violent, only stupid. Can anyone give me any advise or help?
