Our Fs is 2 this week. He's been with us for 1 year. Permanency hearing was today. Going for TPR as neither parent has complied with their plans in any way (mom does come for visits weekly) nothing else. Both parents homeless, jobless, mental health issues (mom's severe- in long term treatment center right now). No relatives have responded in 12 months of inquiries for relative placement.
DH and I love this little guy to pieces. We hope very much to be able to make him a part of our family forever. I'm just so scared that BD is going to panick after todays hearing and start doing some of the things on his plan. Will TPR likely NOT hapen if he miraculously starts trying to do some of his plan in a latch ditch effort? Or will they consider the fact that he has done NOTHING in over a year. If the TPR is not approved does it have to mean immediate RU, or does it just mean no TPR right now and they will keep monitoring? When we went to court today DCS and GAL recommended TPR and a concurrent plan for RU w/appropriate relative. The RU part was dropped by judge as there is no evidence of any appropriate relatives, so recommendation is for straight TPR. Any suggestions, opinions, or insight would be appreciated as I am sooooo worried. Thanks

All I can say is that every judge is different, it's ultimately their decision that will determine what will happen. I've heard of judges TPR'ing right on the spot and others that have given the parents a million chances to get their act together.
From my understanding is that the county is wanting to get the approval to TPR, then you'll have the actual TPR hearing in which it will be approved or denied, then there is a 30 day wait for the parents to appeal the decision. If there is an appeal, worse case senerio it can last up to another year or so with all the hearings to come. I believe while all this is happening until the judge says "TPR granted", RU is going to continue to be the goal. How did the hearing go yesturday? Do you attend the court hearings? I wish you all the best. |
