Arrow Bring Child in USA on H4/H1b

Hi,
Me and my wife is planning to adopt a child from India. We both from India. I am on green card and my wife is on H1-B,her green has been just filed and is in process. As per my immigration lawyer we have max 9
months to complete the adoption process, bottom line, the full adoption should done before her GC got approved.

Q1) So, is it possible adopting a child from India and bring on dependent visa h4 within 9 months?.

Q2) Can we bring child on h4 visa or not?

Till now whatever we heard or read, is not really that promising.

Secondly is financial factor, what is total cost involved? we have gone thru lot of web sites for adoption agencies, some agencies talking about additional cost in india from $3000 - $9000,it is very confusing. is there any hidden cost which agency don't talk about. What i heard that agencies in india are ask for donations, which ranges 5000$ to 15000$ is it right?.
Any suggestion or feedback is highly appreciated.

Alok,

I think one of the most confusing things that people adopting from India encounters is that when you want to bring the child to the US- The USCIS website says "Atleast one of the spouses have to be a US Citizen to bring the child to the US after adopting". But, regarding H1, H4, nobody seems to know the rule for sure- because it's not an immigrant category. But, I just want to say that I've heard that if you adopt as an Indian Citizen it's easier to get a referral, and a younger age child, and faster- (I'm not sure what age you're looking for). But, Im really not sure about the H1, H4 category-- Could you possibly ask your wife to put a stop to her Green Card temporarily so that meanwhile (I think it takes quite a while) you get a referral of the child, etc..
Also, I think most of the agencies in US say atleast one of you have to be a US citizen, to go through the Home-Study, etc.. process for an International adoption.

Your best bet is to consult a reputable and experienced American attorney specializing in adoption and immigration matters.

If you are unable to find one, I will PM you with the names of two people who can either advise you directly or refer you to a qualified person in your jurisdiction.

As per immigration lawyer there is nothing special about adopted child in H4 rules, So he saying that you can bring the child on H4. We want second opinion before we proceed further, if you know a good lawyer please let me know.

Stopping my wife green card process, we thought about it and discussed with lawyer. He suggested we should not stop, as immigration rules are going to change and we don’t know what is going to happen.

Even we have heard same thing if you hold Indian passport, then it is easy to adopt child from India. When you dealing Indian government you never know what is next. SO i was thinking if somebody has adopted from India lately, he/she can tell how, what experience is there.
