Very Bad Court News!!!!!!!!!!!

Again, another let-down as our agency called to say our judge who handles guardianship cases just quit and gave 3 days notice. Friday is his last day and of course NEXT Friday is our court hearing. Supposedly now it'll take Pune 2-8 weeks or longer to hire a new judge. To say I'm disappointed is an understatement and I am greatly regretting adopting from India. Our Chinese adoption was so nice and cut and dried and I'm finding that I preferred that over this not knowing when things will be. Supposedly court was taking 4-6 weeks to get verbal and we're going on 11 weeks and much longer to go. I'm just greatly upset with the Indian government and it seems they don't always put the kids first. I guess I'm back to praying for a new judge to be quickly hired though probably the next judge won't like big families so it'll be postponed again. I'm wondering if Isaiah will be a teenager by the time he's home????? Very upset!!!! Michell

Oh Michell, I'm so sorry that you're going thru all of this! I know there's no words that will make this all better. I just sent you my phone number via pm ... if you need an ear to bend, or just someone to vent at, feel free to shoot me a call anytime!

On the upside, we're in a similiar situation with the judge thing, and our hope is that the new judge will be so totally overwhelmed and backlogged that she'll just stamp everything in the hopes of getting caught up.

*HUGS*

Jo

I know this is tough right now. I thought of other countries too, but my heart is with the child in India. Please continue to pray, with God all things truly are possible.

I'm so sorry to hear this! I'll say a prayer for you and your waiting angel. Try to keep your faith, try to stay positive, *I know it's so much easier said than done right!!?
Someday it will be a distant memory and you'll have your sweet child in your arms.
Prayers for you!

thanks for replies

Hi everybody!! Thank you all for your nice, sincere replies. I am feeling better now and kinda wrote that post in the middle of an emotional moment. We are just praying for a new judge to be assigned ASAP versus the 2 months It just seems as if it's been a long haul. Nothing came easily and between the court closing for May, the compliance with an additional letter needed, and now the judge quitting I just am having the worst luck I do feel better about things now. Michell

I'm glad you're feeling a little bit better. I'm sure if I'd had the news that you got, I'd have reacted in the same way!

This is where its a great thing that we have each other to lean on!

When I was chasing paper for my dossier, I found every little delay would set me off ... We got married in a different country from the one we applied for the marriage licence in, so instead of waiting at the courthouse and getting a copy of the marriage cert on the same day, we had to send for it and it took 10 days. I needed that to apply for my new passport, which I had to send to New Zealand for, and that took another 10 days. I learned to detest the phrase "it'll be about 10 days" ..lol. Now that everything is in India, it doesnt seem so bad.

I'm sure once we have these boys of ours in our arms, all of this won't seem so bad too ...

Talk soon,

Jo

Thanks Jo for your kind words. I am feeling a bit sad as tomorrow is Nitin's birthday. He will be 2 and I just wish I could wrap my arms around him. If court hadn't been closed for all of may I'd be there now as our court date was originally May1 and since they closed all of May it was June1st. Oh well, I pray they find a new judge quickly- Michell

Michell- I am sorry this delay happened at this time for you. I so wish the Indian courts had a family court section which perhaps would be more responsive to these sorts of things. Happy Birthday to Nitin. Our little boy's birthday is in November. Laura

Hi Jo, I remember you posting you were in a similiar situation with the judge thing. Was that ever resolved and how long till they hired a new judge? It's only been 4 days since our judge quit though I'm already impatient Michell

From what I'm hearing, there'll be a new judge starting when the courts resume at the start of July. They might have had a headstart on finding someone though, as the previous judge stopped even showing up to court in mid May, and they told her she was out of office as of June 7th. Of course, we're stuck waiting thru June, when nothing at all can happen due to the closures, and then July becomes an unknown as to how fast this new judge will move, as shes going to be very backlogged.

Esp with your court being closed for May, I would guess they'd want a new judge in there ASAP!

Have you been told how long after guardianship you can travel? My agency said approx 4wks, but another lady I met via a different board who has adopted from India before said they were given the go ahead to travel 2 wks after guardianship.

I really want to be there and back before school starts here in Sept for my other kids. Add to that, my best friend here who was going to watch the kids while we travelled is now moving! Her husband got a transfer with his job, and he may have to leave as soon as July 1st, leaving her to sell the house and follow him as soon as everything is all settled. I'm hoping my mother will fly out from Aussie, but it'll be a problem if school is in, as she won't drive over here ... (the whole wrong side of the road, wrong side of the car thing freaks her out a little..). Yeah, just what I need ... something else to stress about.

Keep me up to date with any news you get on the new judge, and I'll be doing the same..

Talk soon,

Jo

Hi Jo, actually we got a call from our agency and he said they usually always hire a new judge within two weeks so I'm still hoping for another court date before the month ends. I guess it'll take a few days to tie up loose ends as the judge left not signing any verbal guardianship papers of cases that were already finished so the new judge has to do that first. Still hoping for summer travel. Michell

Great news!!!! Thats so awesome!! How long have you been told you'll have to wait after guardianship before you can travel?? I've been told 4wks by my agency, but 2wks by another lady who has already adopted from India ..

Just curious as to what you've been told. Jo
