Illegal immigrant relative adoption

My niece reciently died. Her fourteen year old son, who is my wife and my godson, is not an American citizen though he has been in this country his entire life. The child's father, who, incidentally, was never married to our niece, has suddenly become interested in returning his son to Peru. The father has had little contact with the boy over the years and has lent little or no support to the childs upbringing.

Our godson excels in academics and I believe he has great potential, if he remains in the United States. His father does not have the wherewithal to provide him with the opportunities he has in the United States.

How can we ensure that the boy is not returned to Peru. I know little of the legal system i.e. guardianship of children and addoption.

Please advise

Let me suggest that you contact a good adoption/immigration attorney. There are some issues in this case that will be challenging.

I think the boy's father no longer has interest in invoking parental rights.
