I have been searching for 4 years. I have petitions the county and received non-identifying info. I was made aware through that process that there was a possibility of getting an original birth certificate (with birth mom signature) through the court system. I am in California. Has anyone done it and if so how?

I am also from california and would like to know how do you go about petitioning the court for birth certificate. I heard that there are special types of lawyers out there for that. Please help if you can.

Hello,
I petitioned a Judge in the state I was adopted in. It wasn't even the same town. He gave me a court order to get my original birth certificate, which was sealed once the amended birth certificate was issued. Once I got my original birth certfiicate I had a name and was able to find my birth family. My birth mother had passed away 10 years prior while also searching for me to give me medical info. also. If you petition the court on your own behalf and have a medical doctor state that it is necessary for you to have medical history (isn't that necessary for anyone - why does the law discriminate against adoptees anyway?) - then sometimes a judge will write an order. There are many states now trying to change their laws to allow unconditional access to us adoptees once we reach adulthood, for this very reason. American Adoption Congress (www.americanadoptioncongress.org) is a group of adoptees and birth parents and adoptive parents and professionals who are working towards this. Hope this helps. Growing "Birthright" by Jean Strauss is a good book. |

We are just beginning the search in earnest. I am doing most of the work for my husband. One of our sons was diagnosed with type 1 diabetes and we want to find out medical history as well as normal curiosity. My husband's parents have both passed away and now he feels he can pursue this. Where did you start and how did you petition the judge?
Thanks for the help |

Hi, I am in Canada so I'm not sure if I am any help to you at all but receiving my original birth certificate was the ay I found my birth family. I contacted our Canadian Parliament (the number was in the phone book in the government section under adoption) and it cost me $50 which gave me my birthmom's name, address at time of birth and all info. on her at the time of my birth. Hope this helps

I am from Oklahoma but my experiance might help. Call the courthouse and find out who the judge is that can grant your petition for the original birth certificate. Go the his chambers and fill out the petition. You will then meet with the judge who will ask why you want it released. Be honest and hopefully he or she will do it. In this manner I located not only my birth mother but my father who my mother married. A full-blood brother and sister and a host of other relatives in only a week. God Bless and good luck.

I have many questions and need some others input to gain the information I need. I have already found my bparents through an intermediary and I have a daughter that I am trying to locate, can a bparent petition the courts to get final birth certificate and if so how do I go about it? The adoption took place in Washington State and I now reside in Kansas. Can this be done by mail or does it have to be in person? The agency that handled the adoption has black-listed me for reason beyond my control and I wish to have information to begin my search, also I don't wish to just sit around and wait for her to find me. I have made available any and all my personal information to the agency and to many registers in that state. I hope greatly to find her!!
When searching for my bparents, my adopted family knew someone who knew someone else, who knew the judge to gain the signature for the intermediary. If not for that it would have taken many more petitions to gain access to the names. Now on the other side I do not have the backing of the adopted parent to gain the signatures I need so I am starting from scratch and have no idea how to go about it, not much money to spend on private investigators or intermediaries and such. |
