misdeamoner-can they adopt?

Hey Everyone
Our Neighbors are considering adopting from Guatemala (when they open) and the husband who is in late forties was charged with "disturbing the peace" (playing the stereo loud) misdeamoner charge 20 years ago (he was 27)he has not been in any trouble since-can he still adopt internationally?

has anyone else been in this situation?

Internationally it depends on the country. Guatemala, can't be answered because there is not a process in place. In the old process, yes, Guatemala you could. But Guatemala's old days are gone forever I'm afraid. Your best bet is to select a country since Guatemala won't be an option and check with an agency. Good Luck!

My husband had a misdemeanor, impaired driving. We had to get the charge sheets from the court. He had to write a letter stating how he has learned from it. It was also about 20 years ago. It was fine with the old process.

I had an acquitted felony - criminal trespass 1 from my activist days - and although it was a pain we had no problem. I wasn't convicted but still needed to cover it in the homestudy.

The people at the court told me that b/c it has been so long since I'd been in any trouble I could have the record, sealed. I'm guessing you might be able to do the same thing with a 20 year old misdemeanor. That way if they find a country that wont' let you adopt with an arrest (like Khazikstan) it's not an issue.

Although a sealed record will be undetectible on the local and state level a sealed arrest will show in an FBI report so make sure to inform your homestudy/agency. I wouldn't imagine it would pass for an adoption in a country with No allowed arrests.
