County requiring Birthfather publication for readoption

I did search the forum for this, but could only find threads from 2006. We are in Bristol County MA, and the probate court is requiring that we publish in a newspaper in Guatemala for an "unknown" birthfather (there is no mention of him at all on any documents we received). We are currently attempting to fight it (on our own) with a motion. Has anyone encountered this lately? I'm worried sick over this!

the last time i read about this....probably was in 2006, and it was in MA. did your child come home on an ir3 visa? if so, do they understand that the adoption was finalized in Guatemala. Search those 2006 threads and see who that family was, bc i promise you there was a MA family...maybe they can help!

I would swear it came up again recently, but I am not finding any threads on it now. If you don't get anywhere with what MommytoEli found, I will keep looking.

Also, this case was in Ohio, but someone posted the legal definitions of when birthfather consent in Ohio is required per their law. I am wondering if you can find something similar in the Mass. laws.

readoption...birthfather?...listing in paper? HELP!

From MA too. My daughter came home in Oct. 2005 on IR4 visa and we readopted in Sept of 2005. My MA based agency had mentioned that readoption might be a problem, but it was not as we reside in Norfolk county. A friend of mine also brought a daughter home in Dec of 2005 and still has not been able to change her name or re-adopt for US birth certificate because they are in Bristol count and the judge does not care about Guatemalan laws or the fact that the adoption was finalized in Guatemala. The judge does not seem to care that it is not only a waste of a large amount of money, but that it could actually be dangerous to the birth mother. My friend has appealed, but not successfully. Her agency has not been very helpful either.

Sorry wish I could give you more positive news or help. If you would like to get in touch with my friend, email me and I will hook you up. At least you could pick her brain and maybe help each other out.

Do you have to readopt in the county your reside in?

I live in Michigan and we don't have any provisions for readoption (it just plain can not be done) so I am only familier with readoption from what I read here. But I have seen people recommend on many occassion that someone readopt in another county than the one they live in where the process is easier.

I have no idea if this is possible everywhere or even truthfully anywhere, but throwing it out for what, if anything, it might be worth. Considering the situation, it might be worth a call to your other local counties to see what your options are.

I would suggest seeing if what DPline suggests is true. Here in Colorado you can re adopt in a different county.

also in texas you can readopt in a different county. it made things much easier for us.

Thank you so much to you all who have replied. I have a great social worker who is helping me, so I'm going to ask the question about readopting in a different county - but I don't think it's an option here. It really is amazing how we are treated here - in our own country!
