10 REASONS PGN AND OTHERS NEED TO BE HELD ACCOUNTABLE FOR CONTINUED DELAYS WITH GUATEMALAN ADOPTIONS
1. EIGHT ADDITIONAL MONTHS OF MORE DEMANDS AND MORE DELAYS HAVE LEFT THOUSANDS OF CHILDREN WITHOUT FAMILIES. Attorneys, orphanages, foster families and adoptive families are running out of options and resources in order to provide and protect these children.
2. PGN PROCESS IS 3 DAYS BY GUATEMALAN LAW. Have any cases been reviewed and approved in three (3) days without preferential treatment?
3. DELAYS CONTINUE WITH PGN RESUBMITS. Cases already in PGN and being resubmitted are taking over 4 weeks. Many cases have upwards of 3-5 previos since December.
4. MUNICIPALITIES ISSUING BIRTH CERTIFICATES IN 30 DAYS INSTEAD OF 2-3 DAYS. Birth Certificates are taking approximately 30 days in municipalities such as Mixco, Guatemala city, etc. Then cases are still issued more previos, even after having received PGN previos. Mixco’s website (in writing) says 3-5 days for issuance of birth certificate, yet they are taking minimum 30 days.
5. RENAP DELAYING ISSUANCE OF BIRTH CERTIFICATES. RENAP, which was supposed to help municipalities with the issuance of birth certificates, is delaying Birth Certificates by waiting 30 days. Also, their office relocation is delaying release of Birth Certificates in August by 15-20 days.
6. PAPERWORK FOR PREVIOS NOT BEING RELEASED IN A TIMELY MANNER TO ATTORNEYS. When previo’s are issued from PGN, some attorneys are still waiting several weeks to be able to pick up the paperwork in order to fix the previo.
7. CHILDREN’S RIGHTS ARE BEING VIOLATED. Holds on children of Semillas de Amor are not permitting children to come home to their waiting families, even with signed PGN decrees from the Guatemalan Attorney General, passports and visas. By being held “prisoner” in their orphanage, the children’s rights are being grossly violated.
8. PREVIOS FOR ID CARD COPIES, EVEN AFTER BIRTHMOTHER PRESENTS ORIGINAL ID CARD IN INTERVIEW. Birth mothers attend birthmother interview with their original ID card. After the interviews, cases still getting previos for poor copies of birthmother ID, even though PGN has physically seen and inspected the ID card.
9. NOT ENOUGH PGN APPROVALS. The number of PGN approvals and outs are decreasing and taking longer than ever in the history of Guatemalan adoptions, even after the birthmother interviews are completed. The cases should be coming out at the same rate or even faster with few to no new cases being submitted.
10. CHILDREN IN JEOPARDY BECAUSE BIRTH MOTHERS CANNOT BE FOUND. Many birthmothers thought their responsibility stopped with relinquishing the child, and have since moved in physically and emotionally. Now, another deadline of August is set that punishes these children if their birthmothers are not located.
