Readoption in florida?

Has anyone readopted in FLorida? I am in the process; my Lawyer just told me the judge is going to want a release from the Guatamalan father? My agency says the father isn't involved! Has anyone heard of this? My lawyer said it is a new law?????????? thanks, Terrie

That's terrible! I hope that is a mistake!

Florida is known for being one of the worst states to adopt in. The biological parents have so many rights. Half the time you hear about a 5 yr. being reclaimed by his biological parents, the story is from Florida.

I met a couple in GC that lost 2 kids in a month. One they had had for over a year. They lived in Florida. So sad.

We readopted in Florida in May.
We did have to do a birth father search of the registry, but that was all we had to do that related to the birth father. Wish I could be more helpful!

We are doing a readopt in Palm Beach County. Our son came home on a IR3 visa and we have his COC already so we are basically just looking to change his name.

We had a private company do our paperwork (a paralegal, not a lawyer, and she actually adopted herself and lives close by and says the process here is usually smooth). All paperwork is done and has been submitted...we await a court date. I'll call her tomorrow and see if she's heard anything about this.

I do know that every COUNTY in Florida requires different things so it might not be the state you are up against. My friend is doing a re-adopt in Broward county and they requested that paperwork be "retranslated" here in the US.

I just completed a readoption in Broward . . . there wasn't anything brought up about the birth father. Just my opinion, but it sounds like who ever made this request was uninformed about Guatemalan adoptions. I would challenge anyone who made such a request. It makes sense for a domestic adoption, but not for Guatemalan.

We did a re-adopt in Orange county in March and nothing was mentioned about the birthfather. Our daughter came home on an IR-3 visa if that might matter..

readoption update

We decided to go ahead with the court date of nov. 16th ;Without contacting the birthfather in Guatemala and without doing a home update and see what happens! I have been hearing so many of you in florida who did not have to contact the birthfather and who used their original homestudy for the readoption that I thought I would try. I do not want to open up a can of worms!!!!!!!!!!!!!!! I'll just wait and pray , Terrie from Key West

Terrie ~ Good luck! I just saw that you are in Key West! My two oldest sons (adopted domestically) were born in Key West.

Florida is one of the states granting full effect and recognition to foreign adoption decrees. The law states: full effect and recognition given to decree issured by due process of law by a court of any other jurisdiction within out without the United States. Florida statutes annotated 63.192 (1997) The adoption is final in Guatemala. Florida should recognize this adoption as being final. Did you come home on IR3 or IR4? If its a 3, then your child will receive his/her certificate of citizenship and you make a copy along with all your paper work from your pick up trip to file with the court to get a new birth certificate and a name change. You can do it yourself and not hire an attorney. Good luck.
