Divorce in Guatemala - please help
Hi,
Does anyone have any experience of divorce in Guatemala ? Do you know what the process involves ? How long it takes ? Has anyone encountered this through their adoption journeys ? Our referral is 8mths old and was relinquished at birth to our lawyer. We were told that the birthmother was married and also that her husband had been proven (by dna test) not to be the father. Legally though, the husband is the father (because he is married to the mother). This was not a problem as we live in the UK and can adopt a child with two parents, so we accepted the referral. Now the lawyer is saying that the adoption cannot progress because the birthmother is getting a divorce and we have to wait until this is final before we can proceed. We were told the divorce will be final 'very soon'. No mention of a divorce has been made until now.  Surely if the birthmother was married at the time of the child's birth, the husband will still be the legal father, even if they later got divorced ? We have no idea how long a divorce might take ('very soon' - ?!) or what's involved and have no legal understanding of divorce laws in Guatemala. Can anyone offer us any advice ? Or failing that, any prayer support ? This little girl is already 8 mnths old - I can't imagine what will happen to her if we pull out at this stage but I feel like we have to consider all our options. Please help - we're feeling really low about this all  and more than a little angry about the way I feel we've been treated.

Just thought of this! Have you posted your question on the big list? There is a Guatemalan lawyer who is very active (or was) on the list her name is Susan Lucara, she may have some answers to your questions.
If you are not a part of the big list maybe someone could PM you how to join. I haven't been on for almost two years. Just an idea...Kim
