Birthfather search update--prayers needed

Some of you may recall that late last year and early this year I posted about our re-adoption problem. Our state requires it, but our county doesn't even recognize our Guatemalan adoption. In order to re-adopt, we must conduct a search for the birthfather to give him the chance to claim paternal rights. The search must be done at our expense with the help of an attorney and in a newspaper which is acceptable to the court.

We found an attorney who will help us fight this requirement and--to top it all off--this attorney was granted a hearing for a motion to waive publication. That hearing is Monday. Please pray that the attorney convinces the judge to waive the requirement! I will let you know what happens.

Wow, why in the world would they make you do that? Don't they get that the Guatemalan gov't has already taken care of things like that before we get our babies home??? OMG. I hope that they are able to waive that. Any judge in their right mind would.

I'll be saying a prayer for you too... If things don't go well, couldn't you just re-adopt somewhere else? Our attorney told us that it didn't matter where we re-adopted at because the BC you receive is a 'US issued' BC still showing Guatemala as the place of birth... That might be something to look into...

Just wanted to add that we did our re-adoption in another county from where we live.. We're in FL.. It may be different state to state..

Yes, I am curious too, as to what state you are trying to re-adopt from. I think my agency told me that I needed to do the re-adopt quickly after returning back to AZ because there is some sort of deadline. Maybe they are requiring the extra birth-father search because of this. I have no ideal, myself, LOL, I'm just trying to figure out why if you adopted out of Guatemala, you have to search for the birthfather in the states????

this would be a great idea,
unfortunately it doesnt work in all states.
in our state not only do we have to readopt in our county of residence, but the requirements are pretty different....here you have to wait a year and 2 postplacement visits...20 minutes away in a neighboring county you only need 6 months to readopt and 1 post placement visit.
