Unhappy Do I need to re-file my I600A? If so, HOW?

Here's the background:

Last week I started a thread about my boarder and some bounced check charges filed against her in 1991. These charges are in the process of being dismissed this week (at least this is what the prosecutor told her). Because these charges were open up until this point, my agency informed me that I'd never get through PGN right now and I have to put my adoption on hold for 6 months. I am grateful for their candor because they could have just had me push through and keep shelling out all that money for nothing. I was told by them that I could proceed in attempting to get my I171 (my I600A has already been filed and is waiting for my HS) and I'll be completely paper ready when the six months are up.

Here's the question:

I'm very confused what to do about my I600A. Do I continue with it? Will the fact that the charges have been dismissed, and the file closed, a short amount of time make them deny me even if the crime was over 15 years ago? Do I close the file (and HOW do you do that?) and re-file in 6 months? If I am denied, can I file again?

I am so confused as to what to do and don't want to make a wrong move to make things worse!

Does anyone have any advice? You can PM me if you'd like...

Wow! That is surprising considering that people with much more serious (and recent) offences have been able to adopt. And this is your boarder, not you. (I know, anyone in your household needs to pass the clearance, but . . . ) Have you considered contacting another agency and asking them about your situation and getting a "second opinion?" PGN is picky, but if you have your 171H, I would be surprised if it was an issue for them.

Not sure how you would deal with the I600A. I can't see USCIS refunding your money unluckly. The 171H will be good for 18 months after issue, so even if you delayed accepting a referral, chances are you could still have your child home well before it expired.

With the upcoming hague, I am VERY surprised that an agency is telling you to wait 6 months.

Definitely get a 2nd opinion. When did your homestudy go in? We just got our 171 yesterday from Philadelphia.

My HS has not been submitted yet. It needs an update that includes the dismissed charges. I'm worried about the Hague thing, too. Maybe if I have mt I171, it'll be OK?

No, they'll never refund the money. My HS guy doesn't think it'll be a problem getting approval after the proof of the dismissed charges are submitted with the HS.

My agency said the same thing about the I171...
