Can or should a notary sign without the doctor present?

We had a check up for my two little ones this week.Appt next week for the two older ones at the same doctor. When I told the receptionist about a letter and how it needed to be notorized and did she have a notary in the office...... She told me they did not have a notary but to go to the bank and ask them if I could bring in a signed letter for them to notorize with out the doctor being there. What? She said some notaries don't care if the letter is signed in front of them. Have you ever heard of this? It doesn't sound right to me but if it's okay....... it's alot easier. I don't know what to do.

Also, again please tell me how soon or not so soon the notary should expire. 12 months or 18 months?

We had several documents that a notary was not present for. What we ended up doing was write a letter stating that whatever document is an original and is true to the best of your knowledge and have the notary sign that. So far, that's what has worked for us.

I was told that the notary and the doctor had to sign in front of each other by our agency, but the notary told me that if he knew the doctor personally, he would know his signature and would trust me to bring the letter to him...

A notary is never supposed to notarize a document without actually seeing the person sign it. Sometimes it does happen if the notary actually knows the person that signed the document and recognizes the signature, but I doubt you're going to find a notary that will notarize a signature of someone she/he doesn't know. I work at a law firm and am a notary and actually know of a case where the notary did exactly this and ended up having to testify in court that she didn't actually see the person sign the document and got herself into a lot of trouble.

As a notary by profession this is EXTREMELY Dangerous, if for some reason anyone finds out, the document would be voided and fines/ legal proceedings would occur! Not only to the notary but also the Dr, you and/ or anyone else involved. Its called fraud! There ARE traveling notaries out there ( I should know- thats how I earn my pay check) if you cant find one thru the yellow pages contact a TITLE company ( I know your thinking Im nuts- but thats my job!) In most states notaries close mortgages- and travel to do so ( Closing on location) so they will have a list of notaries in your area that you can contact ( or schedule thru them) to go to your Dr's office and notarize document ( I do it all the time). Do an online search for title companies or signing companies- every state will have some- you might call a national title or signing company and see if they have someone in their data base for your state ( most of them will)

I thought it didn't sound right. Why on earth would the docotors office suggest this..... I guess they don't want to be bothered. I even said I could try to bring my own and that's when they she suggested the bank.

okay another question... I have a friend who is a notary for the company she works for. She recently quit her job but her notary stamp expires in July 2007. Is she still qualified to notorize even though she no longer works for the company where she got her notary license( or whatever it's called) thru? Is July 2007 a far enough date away?

This would be the perfect answer if it's legal. what do you think?

Your friend can still notarize your document. Just because her job ended doesn't mean her stamp is no good. Use her!

If you're a notary, it doesn't matter where you were working when you got your notary license. She will work perfectly for you, and July 2007 should be plenty of time for the expiration date.

We had a traveling notary who was fine with the doctor phoning her immediately after he signed, and us driving the form to her office immediately. The doctor had to give verification over the phone and copies of verification for us to take with the signed form. We did this for an employer letter and physician form when my husband's schedule was hectic and we couldn't make the hours work.

We live in a smaller town and we had the choice of either the girl from the local bank going to the Drs office or she would have been okay with us bringing the letters to her as she is very familar with the Drs signature. I think this happens fairly often...it's just not spoken about much. And really...who in the world is going to know that the Dr wasn't actually present when it was notarized. Just make sure it's all done on the same day. It's very hard to get six sets of physicals notarized.
One other thing I did learn...from the girl at our bank was that she was happy to go to the Drs office. It wasa a curtisy(sp?) the bank provides for our town. She goes to the local Nursing Homes and Drs offices that need things notarized. So that is something you might want to check into. Call the local Nursing Home if you have one and see if they have someone like this in the area.

I know a notary personally and she's notarized things for me a few times without me being present.

With our agency, we didn't have to have the doctor's signature's notarized. We had a statement (on the same page, below the doctor's signature) that said that we swore that the information was true and then we signed our names and had our signatures notarized. We were just told to be sure that our signature and notary date (on that same page) was the same date as the doctor's signature. This was a TREMENDOUS help as it meant we didn't have to drag a notary to the doctor's office with us. We picked up the form and the same day went to a bank and had our signatures notarized. I don't know why more agencies don't do this.

A Fine for illegal notary acts can cost everyone involved tens of thousands of dollars and jail time... For the $25-75 someone might charge you to meet up with the Dr is well worth it- not to mention going to jail wont look so good to the adoption courts! I know it can be inconvienet! But seriously, why let something like that stop you from getting your child? Not to mention I am sure the Dr would love to know he could lose HIS license for that too! ( If a court were to deem his activities illegal- which technically they are)

Forgot to add- a notary can practice anywhere in the state they are lisenced as long as they are current with their lisenceing... ( up until the last day of their term - mine is 9/30/09- so until september 30th ( 11:59 pm) of 2009 I can notarize anything in the state of texas that is presented to me with correct legal notarization wording. ( As well as documented ID of the person I am notarizing- unless I have known them prior to the notary request.)
