Recognition of adoption help!!!

Please help!

I have a 15 month old. I am trying to get the recognition of foreign adoption completed in my county (Huron). They have never done one before. They are telling me that Guat doesn't issue a "final decree" for adoptions. The "protocolo" isn't actually a final decree. So they say that since we don't have a final decree, that I have to have a court appointed social worker do another homestudy ($1200).

This can't be right???????????

The final adoption decree is the document with the heading of Procuraduria General Nacional and you should have the translation of it. DOcument says that they officially authorize the adoption of.....

This PGN document is the one that I submitted with the translation. They say that it isn't the "final" decree. Has anyone else had any trouble with this? I haven't heard of it before? I just am so frustrated with it all. I have recommended them calling a bigger county courthouse that has done them before (i.e. Cleveland), but they have yet to do that.

I might contact my agency to see if they could help.

Certain states recognize the PGN document as the final adoption decree only if you came home with an IR-3. Other states do not recognize foreign adoption and then the families must "re-adopt" in the U.S, even if you came home on an IR-3. In NC it cost's about $1,000.

With an IR-4 you must re-adopt.

Does you state consider your adoption complete if you came home with an IR-3?

My daughter came home on an IR-4 Visa. We did not travel to visit, prior to picking her up.

So this could be true then, that I would have to have another homestudy completed?
It just doesn't seem right. After all that we have gone through to get her home, then to have to do this as well?

We live in Ohio also. You have to do a readoption, and get another homestudy done. It shouldn't cost you that much $ though. The court can appoint a social worker to do the homestudy - this one is much faster, much less work required, only one visit. Or, you can have your original social worker do an update to the homestudy, either way works. If you go the court social worker, it should cost about $200 for the homestudy - not $1,200. Once the homestudy is done, there will be a final adoption hearing scheduled and that's where you can change the baby's name if you want. Most counties have a residency requirement of 6 months in Ohio, although some are different. So you'll need to wait 6 months before the hearing.

Actually, it depends on your state's laws. My son came home on an IR4 and we only needed a Recognition of Foreign Adoption (no homestudy update, no court date - it cost $100 and start to finish took three days!) What state are you in?

Every county in Ohio is different unfortunately! We are in Medina County and did not wait 6 months, used a copy of the same homestudy we already had, needed no attorney and it cost $150. Our SW from our HS agency said every county in Ohio is different in their requirements, she is also an adoptive parent. Sure hope you can get things worked out. (Maybe they could call Medina County! ) The Probate court handles the readoptions and you can find the number by googling Medina county Probate Court. Best wishes!
