Ok... so we went to have our taxes done yesterday by a tax preparer. She worked everything in, including the adoption tax credit. (Federal) & (State) So get this... my dh calls the IRS to talk about the federal adoption tax credit. The IRS rep tells him that we are NOT eligible because our daughter was not a U.S. Citizen when the adoption began. HUH? She came home on an IR-4 Visa and her re-adoption day was 12/30/05. We have not filed for COC because we are waiting on her Missouri Birth Certificate. To make it worse.. the IRS rep told dh that we are not eligible... period. This doesn't sound right. So my question is.... Does this IRS person know what she's talking about? I thought we were eligible this year.. and if not.. then surely NEXT year.. but she is saying "Not at all". This is all becoming a stress fest. Thanks for your input! Trish

OOPs! DH had me confused... please delete this thread! (I don't know how)
Apparently he was talking about qualifying for "Special Needs" on the federal Level. My mistake. In Missouri, all adopted children are listed as "Special Needs", hence the confusion. I'm so sorry for the confusion.. Trish

Internationally adopted do not qualify for special needs adoptions, so if that was the question then IRS lady was correct. You DO qualify for the adoption tax credit otherwise.

Call back and talk to a different person. Most likely you will get a differnt answer and if its better, write that person's name down and contact her directly. It does not sound right. My accountant researched it and the only thing was for us it would be easier if we got the ss# to file.

Find out from someone else. We would have qual'd except income. Then, I guess I didn't file something correctly (imagine that!!) and they re-did it, giving us back <1000 dollars. Best I can tell, they can re-do my taxes anytime!
