Does anyone know what date is used for the adoption credit on your taxes or, to put it another way, what is the official adoption date? Is it the date you get out of PGN, the date you go to the embassy, the date you come home or some other date?

It is the date the US government considers the adoption to be final. If you come home on an IR3 Visa that would be the date your child lands in the US. If you come home on an IR4 Visa that would be the date your 'state requirements' are met...which is tyically your readoption or recognition of foreign adoption date.

that ir4 visa thing was a real bummer for us!
being our state/county has this 6month/1 year thing our tax credit will not be valid until NEXT year.

like my folks said...it's a problem youre glad to have! MIra is HOME now!

Actually I think there was a IRS advisory that came out last year that our tax guy said made the adoption complete when it is complete in the country you are adopting from, so when you get out of PGN. I posted the advisory when I saw it. You might check with an accoutant or tax attorney.

Do you know when that advisory came out? Everything I see on the IRS page concerning this credit still states that the credit can only be taken when the child is a US Citizen and it specifically states the differences between the IR3 Visa and the IR4.

I would really like to find that advisory and read about any changes...but a search of the IRS page isn't showing anything other than the prior information included on the 2004 Adoption Credit Form.

Becky, I will check with our tax guy. I searched the archives and they don't go back far enough, I actually posted the advisory on this board. I think it was last March or April, is there any way to search that far back?

I agree with JennandSteve. The date of your adoption is the date the papers are signed in Guatemala before you leave the country. It has nothing to do with the U.S. Government or readoption in your specific state. Remember, your child has your last name when you enter the U.S. no matter what type of visa you come in on.
