US Embassy Request
I received an email from the US Embassy regarding our pre-approval.
Any one ever gotten this request: If so, how long did it take your attorney to get the document? PLEASE PROVIDE THE FOLLOWING: 20. Photocopy of Midwife's Birth Report. The birth report was not signed by the midwife nor taken to the Health Department. 25. OTHER: Translation of the Authenticity of copied documents. Failure to submit this information by February 28, 2005 may result in denial of your application for Form I-600 Petition to Classify Orphan as an Immediate Relative. ANY DOCUMENTS THAT ARE NOT ORIGINALS MUST BE AUTHENTICATED. ANY DOCUMENTS THAT ARE NOT IN THE ENGLISH LANGUAGE MUST BE ACCOMPANIED BY A CERTIFIED ENGLISH TRANSLATION. (THE TRANSLATOR MUST CERTIFY THAT HE/SHE IS COMPETENT TO TRANSLATE AND THAT THE TRANSLATION IS ACCURATE). Form I-72 PLEASE BRING A COPY OF THIS NOTICE WITH THE DOCUMENTS/INFO REQUESTED.

We were asked for one additional document. This was while our attorney was on Christmas Vacation. Once she submitted it we had pre-approval within 2 days.

What kind of document did you have to get?
How long did it take your attorney to get it and deliver to US Embassy? That's good news about the 2 days turn around..and I don't think our attorney is out of the office.

We were asked for another copy of the Consentimiento. (1st signing of the birth mother's concent for the adoption) Our attorney already had the document and just had to submit it again.

Oh geez, Angela, our processes are going too much the same way. Here's the timing for us: Embassy got DNA report 12/16.
On 12/17, the Embassy sent our attorney a request like yours, except they asked for certified translated copies of our son's bio-siblings' birth certificates. They gave a deadline of 1/16. The atty got the birth certificates to them on 1/12. Maybe it took so long because of the holidays. On 1/13, the Embassy sent a second request due to a discrepancy b/w the attorney's paperwork and the hospital records regarding the number of siblings. The atty got that done last week, so we're hoping to hear something positive from Embassy soon. We are a little worried that the Embassy may be considering investigation with all of this going on... but I'm supposed to be thinking positively these days so I'll put on my and hope for the best.These delays are excruciating, I know! Hopefully your atty can get these documents submitted quickly and that preapproval will come as quickly thereafter as smmars' did.

I know that this was one of the things the Embassy asked for in our case. We didn't get much info about it but something about one being too light and one being too dark. Our case had lots of bumps and was put in investigation but there were lots of issues with our whole case. We also had a pretty incompetent attorney who took forever to get requests in.

I didn't know that there were documents they reviewed like this. I PRAY they don't find something else for gosh sake - I thought all this nonsense was supposed to take place in PGN !!

we were stuck at the embassy waiting for pre-approval for 3 1/2 months. they asked for a certified copy of the divorce decree. it took the lawyer a few weeks to get it submitted. it took us forever to even hear that they were requesting a copy of it. this took place back when preapprovals were taking so long to get a few months ago.
we also ran into a problem with the same thing in pgn except this time they wanted to ex-husband to sign a paper saying he wasn't Zach's father. then the city where the BC was issued investigated things again...it is so redundant. but we are done now and zach has been home a week. everything we waited on seems like a dream now. hang in there. hopefully if they get everything here it will be ready for pgn and you won't get k/o'd except for not having preapproval. amorriso Zach bday 3/8/04 DOR 4/1/04 Gotcha day 1/19/05 |

Actually the embassy has a very important role in making sure the child qualifies as an "orphan" by US standards, so that he/she is able to actually come to the US once the adoption is complete. They also are responsible for making sure that everything involved is on the 'up and up'...if they have any question about this, they will look more closely at the case, possibly even putting it into investigation. I'm not saying that is what is happening here...but keep in mind that they are only asking for the documents that must be provided in order to give you Pre-approval.
By the sound of the request, it almost appears that your attorney just didn't give them the correct documents, or at least in the correct format. So...this sounds as if it is a mistake or omission on the part of your attorney. Hopefully he will have it corrected very soon and you will have your pre-approval.
