Tax Question - Claiming Dependent

Hi All,
Hope someone can help...our adoption was final Dec 16th, 2003 but we did not come home until Jan 28th, can we claim our son as a dependent for 2003?
I know we can take the adoption credit but wondering about this. If anyone can help that would be great.

I believe you can since the adoption decree was signed in 2003... It's possible that there may be a difference if you came home on an IR4 vs an IR3 since I'm not sure the adoption is legally final on an IR4 until you do the readoption.
