Transition Case
Hello Everyone,
I was hoping for some clarification. I was told about an hour ago that my case has not been filed with the Central Authority, but that my case is considered a transition case (3/5 to 6/30). My POA was signed on March 16, 2003. Is anyone else in the same situation as me? Are there many post 3/5, pre 6/30 cases that are not yet in PGN? Thanks for your help! Steve |

Steve, I think there are many cases that are not yet in PGN. PGN will not accept any cases and CA does not appear to be processing any cases.
We were told this morning that amparos will be filed for all our agencies cases because PGN will not accept the files. So, we are out of FC but not yet in PGN because they won't take the files.

My case was kicked out of PGN on 7/14 because they said we did not belong in PGN and then kicked out of CA on 7/19 because they were just not going to deal with it.
So I am nowhere. Donna |

We're in the same boat, Steve. Out of Family Court at the beginning of July and CA wouldn't accept our case. At this point, our agency seems unsure about whether to file an amparo or just try again to file our case with CA.
And, I believe, there are quite a few cases that have not been filed with PGN/CA and are considered transition cases. Christina waiting with Gene for Gabriel |

Apparently there are several of us in the same boat. We are in exactly the same spot. Attorney preparing amaparo as we speak (supposedly).

I'm a transition case too. I think there are a lot of us. It's so sad. If the Hague Treaty wasn't happening, most of our babies would either already be home or would be shortly.
We all just need to have faith. There is a reason this is happening. Our kids will be home.....soon.

Donna - we are nowhere with you!!
Our case was rejected by PGN 6 weeks ago today. For the next four weeks our attorney went everyweek and tried to submitt it to PGN/CA and they have refused to take the file. When people ask how things are progressing I am trying to laugh it off by telling them that we have been in our attorney's brief case for 6 weeks!! It just blows my mind how we can be so close and yet so far away from finishing this adoption!!
Our attorney is filing an Amparo today (hopefully!) I guess we just have to keep our "wait and see" attitude. ![]()

Hello......we are a transition case as well!
Our agency is optimistic about our outcome. I spoke with our coodinator today. As I understand it, a group of attorneys filed a group appeal which hopefully will be decided upon this week. If this appeal is granted, it may lead the way for our case to go through PGN...the way it used to be!!! I am cautiously optimistic at this point! I am still watching and rewinding and watching again the video that we took two weeks ago of our baby when we were in GC. We return to visit our daughter again in three weeks. I keep wondering how many more of these monthly visits we will make until she comes home.......it is so hard to leave her at the end of each visit. She changes and grows so much in just a short period of time. It just doesn't seem fair that we are missing so much of our babies lives due to the government's confusion...okay...okay.....I am just having a momentary "pity-party" for myself and our daughter and everyone else on this same rollercoaster ride! Me too!
I am still in family court, should be out soon I hope... we had to redo a document, or we'd be out now. Accepted referral end of Feb, signed POA same time, not sure when it got registered, but we definitely fall into that "transition" group. That is unless they decided to go by those already in PGN in which case I would throw the biggest fit anyone has ever seen... Hang in there! I'm in the "transitional case" boat with the rest of you. My daughter was born March 21, and my POA was filed May 14.
My agency tells me that nothing is happening with any cases in our situation right now. They are still "waiting to see" if the whole Hague thing is ruled unconstitutional or whether we will have to adhere to the new regs (whenever they are developed!) They also gave me an estimate of 1000 affected US cases.

We are too! Our agency is also being optimistic about our case; we're all waiting for the final word, and for the cases to start moving again.

I'm a transitional case as well. POA registered 3/5. I am not sure if I am out of FC yet. I'm calling the agency tomorrow.

Add me to the list of "transitional cases". I have been out of family court for almost 6 weeks, but "in limbo" like many of the rest of you!!!

We are a transition case as well. Accepted referral 2/28/03. Our agency told us we are "stuck in family court" and that everything is at a standstill until the congressional courts meet this week. I find it interesting that some cases are coming out of family court, but we've been told that we are stuck there!
We visited our baby girl in June and that was the only visit we planned since we anticipated bringing her home by October. I strongly feel this won't happen so I am making arrangements to try to visit every 6 weeks or so until Guatemala gets it together. Money is tight so I plan to pick up some PRN work to cover the costs. I can't think of missing her entire first year.
